1. Acceptance
By accessing Viral AI UGC, you agree to these Terms (“Terms”). If you do not accept, do not use the Service.
2. Eligibility
You must be (i) at least 16 years old, and (ii) legally competent to enter a binding contract under Indian Contract Act 1872.
3. Service Description
We offer a web platform that uses AI models to create user-generated video content featuring virtual characters.
4. Account & Security
- Provide accurate info and keep credentials confidential.
- You are responsible for all activity under your account.
5. Licenses
- Your inputs & uploads: You grant 1811 Labs a worldwide, non-exclusive licence to use them solely to operate and improve the Service.
- Generated Content: We assign to you all transferable intellectual-property rights we have in the Generated Content, subject to these Terms and third-party rights.
- Our software, models & brand: remain exclusively ours; you receive a limited, revocable, non-transferable licence to use the Service.
6. User Responsibilities & Prohibited Uses
You agree not to:
- Violate any law or third-party right.
- Generate or disseminate content that is NSFW, hateful, harassing, misleading, violent, defamatory, infringing, promotes terrorism, or depicts minors sexually.
- Use the Service for medical, legal or financial advice without qualified human review.
- Attempt to reverse-engineer, scrape, overload, or interfere with the Service or models.
7. AI Character Resemblance Disclaimer
Any resemblance between AI-generated characters and real persons, living or dead, is purely coincidental. We do not train models on face scans or biometrics of real individuals without explicit licence.
8. Content Liability
- You own and control publishing of Generated Content.
- You bear sole responsibility for compliance with defamation, privacy, publicity, copyright and other laws when you share or post Generated Content.
- 1811 Labs disclaims all liability arising from your or third-party use of Generated Content.
9. Plans, Billing & Taxes
- Freemium access plus paid subscriptions (“Pro”, etc.).
- Fees, features and limits are posted in the dashboard and may change on 30-days' notice.
- You authorise us (or our payment processors) to charge your chosen payment method.
10. No-Refund Policy
All payments are final. See Refund Policy below. Statutory consumer rights (e.g., EU withdrawal) remain unaffected.
11. Suspension & Termination
We may suspend or terminate accounts immediately for breach. You may delete your account at any time.
12. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT GENERATED CONTENT WILL BE ACCURATE, NON-INFRINGING, OR SUITABLE FOR ANY PARTICULAR PURPOSE.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, 1811 LABS, ITS OFFICERS, EMPLOYEES OR AFFILIATES WILL NOT BE LIABLE FOR (A) INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR (B) AGGREGATE LIABILITY EXCEEDING THE GREATER OF INR 5,000 OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.
14. Indemnity
You agree to indemnify and hold harmless 1811 Labs from claims arising out of (i) your breach of these Terms, (ii) your content or Generated Content, or (iii) your violation of law.
15. Governing Law & Dispute Resolution
These Terms are governed by the laws of India, without regard to conflicts principles. Courts of Bangalore, Karnataka shall have exclusive jurisdiction. We may also elect arbitration under the Arbitration & Conciliation Act 1996 (seat: Bangalore; language: English).
16. Changes to Terms
We may modify these Terms. Continued use after the “Last updated” date constitutes acceptance.
